1. General

a) Scope
This data privacy policy provides users with information on how, to what extent, and for what purpose the data collecting provider (hereinafter referred to as "Vogelsang" or "we," "us") collects and uses their data.
The legal framework for data privacy and data protection is provided by Germany's Federal Data Protection Act (BDSG), section 13 of Germany's Telemedia Act (TMG), and the EU's General Data Protection Regulation (GDPR).

b) Personal data
Personal data is all information regarding a specific or ascertainable natural person. Vogelsang GmbH & Co. KG adheres to the principle of avoiding unnecessary data collection. Collection of personal data is avoided to the extent possible.
Personal data is stored in accordance with the principles of data avoidance and data economy and only for as long as is necessary or as prescribed by law (the statutory retention period). If the purpose for which the information is collected no longer exists or the retention period comes to an end, we will delete the data or block access to it.

c) Right to information
Upon written request, Vogelsang GmbH & Co. KG will inform users of the data saved in connection with their person.

d) Right to correction, deletion, and blocking of data
Users have the right at any time to have incorrect personal data corrected, deleted, or blocked, upon filing an application. As a fundamental principle, the exercise of this right is free of charge, and it may be applied for in a simplified manner via the Contact form or by sending an email to contact@vogelsang.info.

e) Objection
At any time, you may revoke your consent to the collection, processing, and use of your personal data in the future. Personal data will be deleted if you revoke your consent to its storage or if its storage is inadmissible for other legal reasons. Data required for billing and accounting purposes or subject to the statutory retention obligation is not affected by this.

f) Contact
To contact someone with regard to data protection, users can use the general contact information provided on the "Imprint" page or use the Contact form.

g) Use of personal data; limitation to a specific purpose
Vogelsang or a company commissioned by Vogelsang uses your personal data for the technical administration of our websites, for customer management, for product surveys, and for your inquiries, only to the extent necessary in each case or in accordance with the data collection purposes stated at the relevant places on our websites. Our employees and the service provider companies commissioned by Vogelsang are obliged to maintain secrecy and to comply with the provisions of the Federal Data Protection Act.
Furthermore, we ensure that all necessary technical and organizational measures for data protection compliance are taken.

h) Security
Vogelsang takes precautions to protect your data from tampering, loss, destruction, access by unauthorized persons, and unauthorized disclosure. Our security measures are continuously improved in line with technological developments.

i) Advertising
If you provide us with personal data, we will use it to inform you about our products and services and, where applicable, to request your opinion about them, provided you have given us your explicit consent to the use of your personal data for advertising purposes. If you have given your consent to such use, but do not wish to receive advertising from Vogelsang in the future, you may revoke your consent at any time with future effect. Your data will then be deleted accordingly or, where still required for billing and accounting purposes, blocked from access.

2. Use of our website

a) Saving of IP addresses
To improve the design and functionality of our website, data is saved about every instance of website access and about usage behavior, including the IP address. For every instance of website access, the IP address is anonymized (i.e. the last 8 bits are deleted) and saved along with the date and time. This data is only evaluated for statistical purposes and is not brought into connection with the personal data of the users.

b) Geotargeting/geolocation
We use the "geotargeting" function, also known as "geolocation," for our web presence. For the purposes of web analytics, your shortened IP address is matched to a database that stores the IP address pools of various web hosts (providers of data centers) together with their respective locations. Geolocation can thus determine only the general location of the user, not the user's specific physical address. We use this cookie for automatic identification of the browser language, so the user can be forwarded to the correct country website. The information saved includes both the language version detected and the website to which the user was directed.

c) Other cookies
We use cookies for seamless delivery of our website content. The first time a user visits our website, a cookie notice is displayed informing the user in the privacy statement about cookies used and opt-out options. This cookie is saved in the browser until it is deleted there. This means the user only has to enter the settings once.
In addition to the services Google Analytics and Google Maps mentioned separately (2 a, c) and the above-mentioned IP and browser language detection (1 a, b), other cookies are necessary for technical functions. These include standard functions for the use of a website (e.g. the script language PHP) and our content management system TYPO3 (e.g. for the view in the browser).
Furthermore, we use the provider Cloudflare for rapid delivery of our website worldwide (https://www.cloudflare.com/cookie-policy/). Here you are identified as an specific but anonymous user, so you can customize and save your security settings, including whether or not you accept cookies (https://support.cloudflare.com/hc/en-us/articles/200170156-What-does-the-Cloudflare-cfduid-cookie-do).

3. Google services

a) Google Analytics
This website uses Google Analytics, a web analysis service provided by Google Inc. ("Google"). Google Analytics uses cookies. These are text files that are saved on your computer which make it possible to analyze your usage of the website.
Please note that Google Analytics on this website has been expanded to include the code "gat._anonymizeIp();" in order to ensure the anonymized collection of IP addresses ("IP masking"). In this case, however, your IP address will be abbreviated by Google beforehand within Member States of the European Union or in other contracting states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address sent to a Google server in the USA before being abbreviated there.
On behalf of Vogelsang, Google uses this information to evaluate your usage of this website, to compile reports on website activities, and to provide other services to the Vogelsang in connection with website use and internet use. The IP address provided by your browser within the framework of Google Analytics is not brought into connection with other Google data.
You can prevent cookies from being saved by configuring your browser accordingly; please note, however, that in this case you may not be able to completely use all functions of this website. Moreover, you can prevent the data collected by the cookie related to your usage of the website (including your IP address) being sent to Google as well as prevent the processing of this data by Google by downloading and installing the browser plugin available at the following link: Deactivate Google Analytics. This implements an opt-out cookie, which prevents your data from being collected during use of this website in the future.
You can find more detailed information on terms and conditions of use, and data privacy, at https://www.google.com/analytics/terms/us.html and https://policies.google.com/privacy?hl=en-US.

b) Google AdWords
This website uses the online advertising program "Google AdWords" and the associated "conversion tracking" feature. As part of this, Google Adwords sets a cookie on your computer if you reach our website via a Google ad. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of our website and the cookie has not expired yet, we and Google are able to detect that the user clicked on the ad and was redirected to that page. Every Google AdWords customer is given a different cookie. Consequently cookies cannot be tracked via the websites of AdWords customers.
The information obtained using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. The customers are told the total number of users who clicked on their ad and were redirected to a page equipped with a conversion tracking tag. However, they do not receive any information that could personally identify users.
If you do not want to participate in the tracking process, you can easily deactivate the Google conversion tracking cookie in the user settings of your Internet browser. You will then not be included in the conversion tracking statistics. You can find out more about Google's data privacy policy at https://policies.google.com/privacy?hl=en-US

c) Other Google services used
In addition to Google Analytics and Google AdWords, our web presence uses other services such as Google Maps, Google Tag Manager (https://www.google.com/analytics/tag-manager/use-policy/), Google Data Studio (Terms and conditions of use: https://support.google.com/datastudio/answer/7019158?hl=en), YouTube (terms and conditions of use: https://www.youtube.com/t/terms), and Google web fonts. Again, no data that could identify an individual person is collected; instead data is recorded only in an anonymized form, in order to improve the design of our website for you.
You can view Google's statement of its privacy policy here: https://policies.google.com/privacy?hl=en-US. In order to deregister from the services so that your anonymized data is no longer collected, please use the opt-out function at https://www.google.com/settings/ads.

4. Social media services – sharing buttons

On our web presence, we use the privacy-protected plugin "Shariff". This "Shariff" extension, created by the specialists at the computer magazine c't, enables greater privacy online and replaces the usual "Share" buttons of the social networks. More information about the plugin can be found at https://www.heise.de/ct/artikel/Shariff-Social-Media-Buttons-mit-Datenschutz-2467514.html

5. Integration of services and content from third parties

Our web presence sometimes incorporates content and services from other providers, such as the external programming code jQuery from the jQuery Foundation, jquery.org, and images from image databases such as Shutterstock, GettyImages, or iStock. The transmission of the user's IP address may be necessary to allow this data to be loaded and displayed in the user's browser. The providers (hereinafter referred to as "third-party providers") are consequently made aware of the user's IP address.
Although we make every effort to use only third-party providers who require the IP address only in order to deliver content, we have no control over whether the IP address could be stored. This procedure is used in this instance for statistical purposes, among others. When we are aware that the IP address is being stored, we draw this to the attention of our users.

6. Pardot/Salesforce

Pardot is the maker of a web marketing automation suite. We use Pardot’s suite to gather information about visitors to our website. Personal information is stored in Pardot/Salesforce if our visitors complete a form for example for registration to events, contact/request forms or for subscription to our email communications or otherwise “opts-in” to engage with us in a sales and marketing capacity. Non-personal information such as IP address, operating system, web browser, and pages visited is gathered by Pardot.

Pardot cookies don’t store personally identifying information, only a unique identifier.

Visitors receive a message that asks them to opt in on their first visit. The message doesn’t appear again unless they clear their cookies. If a prospect opt out of tracking, Pardot treats them as if their cookies are disabled. Email link clicks and form submissions still appear in their activity history, but their page views and form views don’t.

We collect your data so that we can communicate with you in an accurate and appropriate way, whatever your relationship to Vogelsang: that is our legitimate interest in processing your data.

We will only hold on to personal data for as long as we need it for the purpose it was collected or for as long as we are legally required to do so.

We have put in place appropriate technical and organizational precautions to prevent the loss, misuse, access to or alteration of your personal information in an unauthorized way.

Additional information pertaining to Pardot/Salesforces’ policies can be read here.

7. MultiView

This site utilities a MultiView Tracking code which is used to track web page views and other on-site interactions in support of marketing and digital advertising activity.

MultiView is based in the United States, and personal data collected by MultiView worldwide (including within the EU and Switzerland) may be transferred to the United States for processing. MultiView complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data transferred from the European Union and Switzerland to the United States. MultiView has certified to the Department of Commerce that it adheres to the Privacy Shield Principles.

This system uses technical and behavioral information gathered from the cookies and other technologies to optimize the consumers “experience.” In some cases, cookies are used to prevent you from seeing unnecessary advertisements, needing to log in more than is necessary for security, and remembering your saved preferences. Cookies, in conjunction with our web server’s log files, allow us to calculate the aggregate number of people visiting our website and which parts of the site are most popular. This helps us gather feedback in order to constantly improve our website and better serve our customers.

The technical and behavioral information gathered from our cookies and other technologies automatically build anonymous behavioral profiles. These profiles do not identify you personally but allow the system to deliver advertisements that are more likely to be interesting or relevant to you (interest-based advertisements) on behalf of our customers. We may share technical and behavioral information and behavior profiles with our customers as part of working with them to determine what kinds of interest-based advertising to place, and where.

Disabling cookies on your device or browser may limit or prevent our building of behavioral profiles from your activities in the such device or browser.

10. Changes to our data privacy policy

In order to ensure that our data privacy policy always complies with current legal requirements, we reserve the right to make changes at any time. This also applies in the event that our data privacy policy has to be adapted due to new or revised content, such as new service offerings. The new data privacy policy will then take effect on your next visit to our website.
